If, like many other people in your position, your timeshare is beginning to feel less like a luxury and more like a financial burden, then it may be time to start looking for professional help (from specialist SRA regulated solicitors) to say goodbye to your unwanted timeshare.
Here at Athena Law, we pride ourselves on giving each of our clients a reliable, valuable service to help them with their timeshare complaint. We believe that no one should be forced to stay with a contract that they do not want and we will endeavour to help you however we can. We know just how difficult it can be facing timeshare companies alone and we have helped hundreds of people who have tried every other avenue to relinquish their contract.
Why is it so hard to deal with Timeshare companies?
The chances are that you, like many of our clients, have already attempted to start the process of leaving your timeshare and may have spoken directly with your timeshare company. It could be that your financial or lifestyle situation has changed, that you are no longer happy with the resort or, for another reason entirely that you want to leave. Whether you are very newly into your contract or have been holidaying at your timeshare resort for many years, the simple matter of the fact is that you no longer want your timeshare and you have decided to try to cancel your agreement. After making contact with the Timeshare Company it may well be that you’ve now realised that contract that was so easy to enter into is proving incredibly challenging to leave.
Unfortunately, many resorts bind their customers into confusing contracts with long-term implications (which comes under an issue of fairness for the buyer). In the past, timeshares were doing very well – timeshare resorts were making good profits from maintenance fees and they had a good reputation. The ease of acquiring new owners meant that resorts could use the ‘fee pot’ to upkeep their grounds and keep clients largely happy within their contracts while confidently making a good profit.
Now, the timeshare reputation story is very different, and timeshare resorts will do almost anything to cling onto their owners to stay afloat. Popularity for timeshare has rapidly lessened over the years due to their increasingly negative reputation. This means Timeshare Companies are much less willing to let you out of a contract easily for fear of losing your annual fee. However, it is this very fee that can cause so much grief in the first place. Rising maintenance fees that weren’t properly explained during the timeshare sales pitch can leave people in a huge financial strain and feeling desperate, frightened and trapped. Some owners are unable to keep up with the rapidly increasing costs and have received letters from the Timeshare company or even bailiff’s letters as a result of stopping payments.
We believe that Timeshare Companies have a duty of care to their members and should be treating owners with fairness and respect. Many timeshare owners are pleased in their contracts and have never had the desire to leave, but when and if an owner decides they do want to go, we believe it is their right to make this choice.
How should you deal with a Timeshare Company?
You may be wondering ‘Why can’t I just hand back my timeshare?” or “What if I just stop paying?” but, if you have already spoken to your Timeshare Company and they have said leaving isn’t an option then we would never recommend just stopping paying your fees. We put together an article on ‘How to exit your timeshare legally’ which you can read here. If you simply stop paying your fees it is very likely that legal action will be taken out against you once the debt owed gets high enough to warrant intervention from the resort.
We strongly recommend that if you have already spoken to your timeshare company and haven’t made any progress, that you get in touch with our specialist timeshare solicitors today so that we can advise you on your next steps to ensure you can both exit your contract and avoid more fees from legal action against you yet.
Why do I need a specialist to help me exit my timeshare contract?
Timeshare contracts are full of legal jargon and complexities. It is for this reason that so many people struggle if they try to ‘go-it-alone’ to exit from their contract. A specialist solicitor is highly experienced in timeshare law and will be able to spot irregularities, flaws or clauses which could help you leave your contract. We have had many successful cases here at Athena Law, and we have assisted clients both with finally getting rid of their timeshare contracts and also with winning compensation if their contract has been illegal (such as a contract which is in perpetuity).
We work closely with all of our clients to understand their unique situation and frustrations so that we are placed in a strong position to advise you on the next steps you can take. We have many years of experience in this industry and many success stories for clients who have been in your position, and we may be able to help you too.
